These terms apply to your use of our website and purchases made from us as a consumer. They cover all products we sell, including lamps, LED grow bulbs, smart plugs, accessories and customised products.
2. Products and brands
Our range includes products assembled by us, products manufactured for sale under our own brands, and products from other manufacturers sold under their brands.
The relevant brand, specifications and features are shown in each product listing.
When you purchase from our website, your sales contract is with High Rise Farming LTD. Your statutory rights against us apply regardless of who manufactured the product.
3. Your order and our contract
Please check your order before submitting it and provide accurate contact, delivery and payment details.
For standard products, your order is an offer to buy from us. Our order acknowledgement confirms receipt but does not mean we have accepted it. A contract is formed when we send your dispatch confirmation.
For bespoke orders, we will confirm the agreed specification, price, payment arrangements and expected delivery period before accepting your order. A contract is formed when we send written acceptance of your bespoke order. We will not begin manufacture before acceptance.
If we cannot accept your order, for example because a product is unavailable or payment cannot be processed, we will explain this and promptly refund any payment taken.
4. Payment
Available payment methods and the timing of payment will be explained before you place your order.
You may cancel a standard order at any time before dispatch without charge. We will cancel any outstanding payment authorisation and refund any payment taken. Your bank determines when released funds become available.
Bespoke orders are subject to the payment arrangements agreed when ordering and the cancellation provisions in section 7.
We will notify you of material delays. Delivery estimates do not remove your legal rights if delivery is late.
5. Prices and product information
Prices shown for UK purchases include UK VAT. Applicable delivery charges will be shown before you order.
Shipping for Anthos is included in its price. Anthos is sold at one price throughout the year, with no time-limited or founder offer. These pricing statements apply specifically to Anthos.
If we discover an obvious pricing error before accepting your order, we will contact you. You may choose to proceed at the correct price or cancel. We will not charge a higher price without your agreement. If the order does not proceed, we will refund any payment taken.
Product descriptions and agreed specifications form part of your contract. Colours may appear slightly different on different screens, but this does not affect your right to receive products that match their description and agreed specification.
Please check the product listing for dimensions, electrical ratings, bulb fittings, dimming compatibility and any other compatibility requirements. If you are unsure whether a product is suitable for your intended use, contact us before ordering.
Changes to our website will not change an existing contract without your agreement.
6. Availability and delivery
Available delivery destinations, charges and restrictions will be shown before you order. Availability may differ between products.
Chloro is offered for sale in the UK only and is not offered for sale in the United States.
Unless we agree a different delivery period with you, we will deliver without undue delay and within 30 days of the contract being formed.
If we cannot meet the agreed delivery period, we will contact you. You retain your legal rights to require delivery or end the contract where the law allows.
Products remain our responsibility until they come into your physical possession or that of someone you nominate to receive them. If you independently appoint a carrier we have not offered, responsibility passes when we hand the products to that carrier.
7. Cancellations and bespoke orders
For standard products bought online, you normally retain the statutory right to cancel up to 14 days after the day you receive them. Contact info@lampsandplants.co.uk to notify us of a cancellation.
Some products, including certain Chloro orders, may be made to your individual specifications or clearly personalised. Please check all agreed specifications carefully before confirming your order.
Where a product qualifies for the statutory exception for goods made to your specifications or clearly personalised, the usual 14-day change-of-mind cancellation right does not apply. We will explain this before you order.
Once we have accepted a qualifying bespoke order, we do not offer change-of-mind returns or refunds. Subsequent changes to the specification must be agreed with us in writing and may affect the price or delivery period.
This exception does not apply merely because a product is assembled to order or selected from standard options where the law still provides a cancellation right.
Nothing in this section affects your rights where goods are faulty, unsafe, not as described, do not match the agreed specification, or where you otherwise have a legal right to cancel or receive a refund.
8. Faulty products and warranties
We must supply products that meet your statutory rights, including being of satisfactory quality, fit for purpose and as described.
If a product is faulty or does not meet the agreed specification, contact info@lampsandplants.co.uk with your order details and a description of the problem.
Depending on the circumstances, your legal remedies may include rejection and a refund, repair, replacement or a price reduction. These rights also apply to bespoke products and products manufactured by third parties.
Any warranty offered by us or a manufacturer is additional to your statutory rights. Its duration, coverage and conditions will be stated in the relevant warranty information.
You do not have to pursue a manufacturer’s warranty instead of exercising your statutory rights against us.
9. Product safety and use
Use each product only for its intended purpose and in accordance with its supplied instructions, electrical ratings and installation requirements.
Unless expressly stated otherwise in the product listing and instructions, our electrical products are intended for indoor domestic use.
For lamps and LED grow bulbs, follow the requirements for compatible fittings, maximum wattage, dimmers, positioning, ventilation and clearance.
For smart plugs, follow the manufacturer’s maximum load limits and restrictions on connected appliances. A smart plug does not make an appliance suitable for unattended or remote operation where the appliance’s instructions prohibit it.
Use the power supply, cable and plug specified for the product. Do not open sealed electrical housings, modify electrical components or bypass any required earth connection.
If a product, cable or power supply appears damaged or develops a fault, stop using it and contact info@lampsandplants.co.uk.
Nothing in this section restricts your statutory rights.
10. Smart products and connected services
Some products require a compatible phone or tablet, internet connection, wireless network, app or third-party account to access certain features. Relevant requirements and any known mandatory subscription charges will be disclosed before purchase.
Third-party apps and services may have their own terms, which you should review before use.
Follow the supplied setup and security instructions and install updates required for safe and proper operation.
Our use of third-party manufacturers, apps or services does not remove our responsibility to supply products that meet their description and your statutory rights. If an advertised connected feature does not work as it should, contact us.
11. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of contract or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is an obvious consequence or if, when the contract was made, both you and we knew it might happen.
Nothing in these terms excludes or limits our liability for:
-
Death or personal injury caused by our negligence.
-
Fraud or fraudulent misrepresentation.
-
Liability for defective products under the Consumer Protection Act 1987.
-
Any other liability that cannot lawfully be excluded or limited.
Nothing in these terms excludes or restricts your statutory consumer rights.
Our responsibility to you is not limited by whether a manufacturer, supplier or insurer accepts or pays a claim.
12. Website use
Do not use our website for fraud, unlawful activity, harassment or interference with its security or operation.
We may restrict access where reasonably necessary to address misuse. This does not remove your rights under an existing order.
If you create an account, keep your login details secure and contact us if you suspect unauthorised access.
13. Website content
Website text, photographs, designs and branding belong to us or their respective owners. Third-party product names and trademarks remain the property of their respective owners.
You may use the website for personal shopping and reference. Other reproduction or commercial use requires permission unless permitted by law.
14. External links
External websites have their own terms and practices. A link does not itself mean we endorse that website.
This section does not exclude any responsibility we have under law.
15. Complaints
Please contact info@lampsandplants.co.uk or write to our business address, giving your order number where available and a description of the problem.
We will investigate and respond. You do not have to complete our complaints process before exercising your legal rights.
16. Changes to these terms
We may update these terms for future orders.
Your purchase remains subject to the version supplied when you placed your order, unless a change is required by law or expressly agreed with you.
17. If part of these terms is unenforceable
If a provision is unlawful or unenforceable, the remaining provisions continue where legally possible.
A delay in enforcing a right does not by itself waive that right.
18. Governing law and courts
These terms are governed by the law of England and Wales.
If you live in Scotland or Northern Ireland, you retain the protection of the mandatory consumer laws that apply where you live. You may bring proceedings in the courts of England and Wales or in the courts of the part of the UK where you live.
If we sell and deliver products to consumers outside the UK, nothing in these terms removes mandatory consumer protections or rights to bring proceedings in local courts that apply under relevant law.
